These Terms of Service govern access to and use of the Terrace & Twinberry website. By using the website, you agree to these terms. If you do not agree, you should not use the website.

1. Eligibility

You must be legally capable of entering into a binding agreement or use the website with the permission and involvement of a parent or legal guardian.

2. Permitted Use

You may use the website for lawful personal shopping and related purposes. You must not:

• use the website for fraudulent, abusive or unlawful activity;
• interfere with its operation, servers or security controls;
• introduce malware or attempt unauthorized access;
• scrape or commercially exploit content without permission; or
• submit false, misleading, defamatory or infringing material.

3. Product Information

We take reasonable care to present product descriptions, measurements, materials, colours and images accurately. Screen settings, lighting and manufacturing variations may affect appearance.

Nothing in this section excludes rights relating to materially inaccurate descriptions, defective products or misleading representations.

4. Website Availability

We may maintain, modify or temporarily suspend parts of the website. We do not promise uninterrupted or error-free access, but this does not exclude obligations that cannot legally be waived.

5. Customer Accounts

You are responsible for keeping your login credentials confidential and for activity conducted through your account. Notify us promptly if you suspect unauthorized access.

Unless otherwise stated, the website design, text, photographs, graphics, branding and other original content are owned by or licensed to Terrace & Twinberry and protected by applicable intellectual-property laws.

You may access this material for personal, non-commercial use. No ownership rights are transferred to you.

If you submit a review or other content, you confirm that you have the right to provide it and that it is accurate, lawful and non-infringing.

You grant us a non-exclusive, worldwide, royalty-free licence to display and use that content for operating and promoting the store, subject to applicable privacy law.

9. Fraud and Prohibited Transactions

We may investigate, decline or cancel transactions reasonably suspected of fraud, payment abuse, unauthorized resale or unlawful conduct. If payment has been collected for a cancelled order, we will refund the relevant amount unless the funds must legally be withheld.

10. Liability

To the maximum extent permitted by law, we are not responsible for indirect or consequential loss arising solely from website use where that loss was not reasonably foreseeable.

Nothing in these terms excludes liability or legal remedies that cannot lawfully be excluded.

11. Indemnity

To the extent permitted by law, you are responsible for loss reasonably resulting from your unlawful use of the website or material breach of these terms. You are not required to indemnify us for loss caused by our negligence, unlawful conduct or breach.

12. Restriction or Termination

We may restrict access where reasonably necessary to address unlawful activity, security threats or a serious breach of these terms. Provisions intended to survive termination will continue to apply.

13. Governing Law

These terms are governed by the laws of British Columbia and applicable federal laws of Canada. The parties submit to courts with jurisdiction in British Columbia, without restricting a consumer’s right to use another competent forum provided by law.

14. Changes

We may update these terms by publishing a revised version. A change will not retrospectively alter an order already accepted unless required by law or agreed with you.
